MoonPay Terms of Use

This page sets out the terms and conditions that govern your use of the following MoonPay services:

• MoonPay Rails
• Express Checkout
• MoonPay Balance
• Virtual Account Services (sometimes also referred to as Stablecoin Settlement Services or Iron Services)
• Access to the MoonPay.com website or any other consumer mobile or desktop applications offered by Launchpad or the MoonPay Group (“App Services”); 
• The use of a MoonPay Account (“Wallet Services”); 
• The ability to connect your MoonPay Account to other Wallets you may hold at other cryptocurrency Exchanges or any other self-custody Wallets you may hold, in order to access those wallets from the MoonPay platform (the “Software Services”)
• The ability to use and interact with certain connected services directly by command line using MoonPay CLI (“MoonPay CLI”) or Dawn CLI (“Dawn CLI”).

Please note that not all MoonPay services are available in all jurisdictions. For example, Express Checkout is currently not available in the EEA, UK, Australia or New Zealand. If you change your location of residence, please note that different terms may apply, and your continued use of MoonPay's services would be under the terms of the new jurisdiction that you have moved to.

If you are using MoonPay Rails, MoonPay Balance (where available) or Virtual Account Services, the following terms apply:

• If you reside in the USA or Canada, the MoonPay USA LLC Terms of Use;
• If you reside in the UK, the MoonPay (UK) Limited Terms of Use;
• If you reside in the EEA, the MoonPay Europe B.V. Terms of Use;
• If you reside in Australia or New Zealand, the MoonPay AUS Pty Ltd Terms of Use; and
• If you reside in any other supported jurisdiction, the MoonPay Jersey Ltd Terms of Use. 

If you are using the Express Checkout services, the following terms apply:

• If you reside in the USA or Canada the MoonPay USA LLC Express Checkout Terms of Use; and
• If you reside in any other jurisdiction, the MoonPay Jersey Ltd Express Checkout Terms of Use.

If you are using the App Services, Wallet Services, Software Services, MoonPay CLI or  Dawn CLI, the Launchpad Limited Terms of Use apply. These services are not regulated financial services and are not subject to the same regulatory protections that apply to MoonPay’s regulated entities. Where such services are made available to you, separate Terms of Use will apply.

Please note:

• Additional policies and terms may apply, including risk warnings and pricing information. They are available on the Legal section of MoonPay’s website. 
• MoonPay may use external third party providers (“Third Party Providers”) to support the delivery of its services. Depending on the service you are using, you may be required to accept the Third Party Provider’s terms of use and/or enter into a separate contract directly with the Third Party Provider. Where acceptance of MoonPay’s Terms of Use will also result in acceptance of a Third Party Provider’s terms, this is explicitly set out in the relevant MoonPay Agreement.
• The MoonPay USA LLC Terms of Use, MoonPay USA LLC Express Checkout Terms of Use, the MoonPay Jersey Ltd Terms of Use, and MoonPay Jersey Ltd Express Checkout Terms of Use include Dispute Resolution terms that govern how claims that you and MoonPay have against each other are resolved, including an Arbitration Agreement (See Section 10 of the MoonPay USA LLC Terms of Use, Section 8 of the MoonPay USA LLC Express Checkout Terms of Use, Section 25 of the MoonPay Jersey Ltd Terms of Use, and Section 22 of the MoonPay Jersey Ltd Express Checkout Terms of Use).  If your use of MoonPay services is subject to one of these Terms of Use, please pay special attention to these sections.
