MoonPay Promotions Terms and Conditions

READ THESE PROMOTIONS TERMS AND CONDITIONS (“PROMOTIONS TERMS”) CAREFULLY  BEFORE PARTICIPATING IN ANY PROMOTION OR OFFER (EACH A “PROMOTION”). YOU WILL  BE DEEMED TO HAVE ACCEPTED THESE PROMOTIONS TERMS AND AGREE TO BE BOUND BY THEM WHEN PARTICIPATING IN ANY PROMOTION.

The MoonPay User Agreement and Privacy Policy apply for all Promotions. When we use the term “we” or “our” in these Promotions Terms, we are referring to MoonPay USA LLC or, as applicable, its affiliates. When we use the term “you” in these Promotions Terms, we are referring to you, the participant in the Offer. 

1. These terms and conditions apply to all MoonPay Promotions, unless otherwise specified. 
2. You must complete MoonPay account onboarding and be in compliance with the User Agreement to be eligible to receive the Promotion. In order to verify your eligibility for a Promotion, we might require that you provide us with proof of your age, identity and/or residency. We reserve the right to refuse or terminate your participation in the Promotion if you are in breach of the User Agreement or these Promotion Terms.
3. Certain Promotions may only be available to customers located in the United States.
4. Certain Promotions may only be redeemed by new users of the MoonPay Services on their first one or more transactions. If this is the case, you will not be eligible for the Promotion if you have previously used MoonPay and/or have a MoonPay account. Additionally, you will be disqualified and will not be entitled to receive the Promotion if MoonPay determines, in its sole discretion, that you are using a VPN, shared device, shared identification credentials, or are otherwise suspected of fraudulent activity.
5. Certain minimums may be associated with the Promotion and must be met in order for you to be eligible for the Promotion. 
6. If a Promotion includes a discount on fees, such discount shall only apply to processing fees; network fees still apply. 
7. A Promotions is a limited time offer. 
8. A Promotion is limited to one per verified customer.
9. A Promotion is good while supplies last. 
10. A Promotion may not be combined with other promotions or offers.
11. A Promotion is not transferable and may not be auctioned, traded, copied, transferred, modified or sold. 
12. A Promotion cannot be applied retroactively. 
13. You may not be eligible for the Promotion if you are employed by MoonPay or one of its affiliates; have a family member that is employed by MoonPay or one of its affiliates; or are an agent or third party directly associated with the administration of the Promotion.
14. Unless otherwise stated, the expiration of a Promotion shall be at 23:59 UTC on the applicable end or expiration date. MoonPay’s computer is the official date/time keeping device for all Promotions. 
15. You are responsible for paying any applicable tax related to the use of a Promotion. MoonPay has no obligation for payment of any tax in conjunction with the distribution or use of any Promotion.
16. If applicable, third party terms and conditions may apply to any part of the Promotion.
17. Void where restricted or prohibited by law. 
18. We do not assume any responsibility for any typographical or other error in the administration of the Promotion.
19. We reserve the right to void, cancel, suspend, or amend the Promotion.
20. We reserve the right to modify and amend these terms and conditions from time to time during the Promotion.
21. In the event that any provision of these Promotions Terms is unenforceable under applicable law, the validity or enforceability of the remaining provisions will not be affected. To the extent any provision of these Promotions Terms is judicially determined to be unenforceable, a court of competent jurisdiction may reform any such provision to make it enforceable. The provisions of these Terms and Conditions will, where possible, be interpreted so as to sustain its legality and enforceability.
22. Our failure to enforce any term of these Promotions Terms will not constitute a waiver of that term or any other provision of these Promotions Terms.
